For good and valuable consideration, receipt and sufficiency of which is hereby acknowledged, I irrevocably grant to Encore Worldwide and Hunter (“Agency”) and the client identified below (“Client”), and each of their respective agents, licensees, nominees, parents, subsidiaries, affiliates, successors and assigns and all others acting with the permission of Agency or Client, and the directors, officers, employees, and shareholders of each of them (collectively, the “Grantees”) the absolute right and consent to use (including, but not limited to, to reproduce, display, broadcast, televise, publish, post and distribute) without restriction or limitation: (1) my name, signature, biographical information, performance, voice, portrait, photograph and/or any other likeness of me (including a caricature), either in whole or in part, and in any and every form, style, size or color, and (2) my statements, opinions, and/or testimonial, if any, in whole or in part, as edited by Agency and/or Client (collectively, my “Image and/or Statements”) in advertising and promotional materials for Client (the “Advertising”) for advertising, publicity, business trade or art purposes, or for any other legal purpose, in perpetuity, throughout the world, in any and all media, whether now known or hereafter developed, including but not limited to print media; broadcast media; out-of-home media and/or venues; collateral media; electronic media and the internet; industrial media and/or venues; and programming. I agree that my Image and/or Statements may be used alone, with each other, and/or with captions, film, artwork, audio track, photographs, or any other material.
I hereby affirm that any statements or opinions expressed by or attributed to me in the above-referenced Advertising are a true and accurate reflection of my opinions about Client and its product(s)/service(s), including any product(s)/service(s) that may be listed below. In the event that I am providing a testimonial about such product(s)/service(s), I hereby affirm that I am a bona-fide user of such product(s)/service(s).
I hereby release the Grantees from any and all liability arising out of the aforementioned use, including, but not limited to, any blurring, distortion, alteration, optical or auditory illusion that may occur or be produced in or by the taking, reproduction, broadcast, publication, processing, or creation of the Advertising, or any other display of my Image and/or Statements. I further agree that Grantees are under no obligation to use my Image and/or Statements in any way.
I hereby waive any right that I may have to inspect and/or approve the Advertising, including but not limited to the copy that may be used in connection therewith, and/or to the use to which the Advertising may be applied. I hereby assign all my copyrights, privacy, publicity or any other property rights, if any, in and to the Advertising or any part thereof to Agency as agent for Client.
In connection with the grant hereunder, I understand that I may come into possession of information or materials that are confidential, trade secrets or otherwise considered secret by Agency and/or Client (“Confidential Information”) which may include, without limitation, plans, layouts, storyboards, scripts, and other information regarding Agency’s and/or Client’s advertising, marketing and sales promotion, products, services and strategies, and any other information deemed confidential, whether or not marked confidential or proprietary. I agree to maintain all aspects of this Release and the Confidential Information in the utmost of confidence and agree not to disclose the Confidential Information.
I warrant and represent that this consent does not in any way conflict with any existing commitment on my part. I have not heretofore authorized (which authority is still in effect), nor will I authorize or permit for the term of this consent, the use of my Image and/or Statements in connection with the advertising and/or promotion of any product or service competitive with the product(s) and/or service(s) of Client listed below.
I am at least sixteen (16) years of age or the age of majority in my state of residence and have the full right to make this agreement and grant the rights set forth herein. If I am not at least sixteen (16) years of age or the age of majority in my state of residence, my parent or guardian, who represents that he or she has the full authority to sign on my behalf, shall instead make this agreement and grant the rights set forth herein, on my behalf. In the event that my Image and/or Statements are used in any advertising which is subject to the SAG-AFTRA Commercials Contract, I agree to sign such standard contract and to be paid scale rates.

In consideration of the opportunity to participate in the Lysol Air-aoke and related activities (collectively, “the Event”), I understand that I must be at least sixteen (16) years of age to participate in the event. I understand that participation in or attendance at the Event involves the risk to the Participant of accident, personal and bodily injury (including death) and property loss or damage, which may result from the Participant’s own actions or inactions, as well as the actions or inactions of others, or from the condition of the facilities, equipment and vehicles used at the Event. I have considered the nature and extent of the risks involved and I voluntarily choose, on behalf of myself and/or any minor Participant, to assume all such risks, even if the risks are not known to the Participant or me and are not reasonably foreseeable at this time, and I assume full responsibility for my and/or any minor Participant’s participation in the Event.
